Default unsrupuluse car park scam

I have just received a car park charge of 100 for being in a retail car park past the car park opening time even though the shops were still open and aldi does not shut till 1 hour after that time

this is a warning to anyone entering one of these sites even just to turn around they will take your no. On entry and on exit then send you a charge

there is no barrier to stop you entering and the parking clauses are inside and not visible until you have entered

Surely it's not enforceable?

Was a test case recently so I think it can be enforced.

Update

having contacted aldi customer services they have told me that they are aware of the problem and will get the charge canceled

apparantly the car park company ukcp have just taken over the running of the car park , this still does not give them an excuse for daylight robbery

also I have been told that a parking charge is a contract between them and a driver but as the car park is closed then no contract can be entered into and only the owners can then claim a trespass has accrued and take you to court should they wish

Well, here his his defence .the sign is what is known in law as a forbidding contract.

It makes it very clear there is no parking after21:00

Therefore they can not offer a contract to park for 100 after21:00as parking is forbidden.

So anyone parking after21:00is a trespasser who can only be succesfully sued by the landowner not the parking firm.

There is no contract in place for them to pursue a parking contractual charge.

It is not a fine, it is a contractual charge for parking.

Parking is forbidden after21:00so they can not offer a contract to park on forbidden terms.

I would await them to send county court papers and counter sue for harassment and costs.
